Can I become legally single before every issue in my divorce is resolved?
In some cases, yes. California allows a spouse to ask the court to decide marital status separately from other unresolved divorce issues. This process is often called bifurcation of marital status. If the court grants the request, your marriage can end while issues such as property division, support, or custody remain pending. California’s minimum six-month divorce waiting period still applies, and the court may require certain conditions before ending marital status early.
What happens if my spouse and I reconcile after filing for divorce?
If you no longer want to continue a divorce or legal separation, you may be able to ask the court to dismiss the case before judgment. If you started the case and your spouse has not filed a Response, you can generally request dismissal without your spouse’s signature. If your spouse has already filed a Response, both of you generally need to agree to dismiss the entire case. If you later decide to divorce after dismissing the case, you will need to start a new case.
Can I restore my former name as part of a California divorce?
Yes. If your divorce is filed in California, you can ask the court to restore a former legal name, such as the name you used before marriage. You can request the change when the divorce is finalized. If your divorce is already final, California also provides a process for asking the court to restore your former name afterward. Restoring a former name through the divorce does not automatically update your driver’s license, Social Security record, passport, or financial accounts. You must update those records separately.
