What Makes a Divorce Uncontested in California?

For the court to enter an uncontested judgment based on your agreement, you and your spouse must agree on all issues that need to become part of the final judgment. Reaching full agreement can reduce the number of matters that require hearings or a judge’s decision, but it does not remove California’s filing, disclosure, and waiting requirements.

Depending on your circumstances, your agreement may need to address:

  • Dividing property and debts
  • Spousal support, including whether either spouse will pay support
  • Child custody and parenting time, if you have children
  • Child support, if you have children
  • Other issues that the court must include in the final judgment

California also requires financial disclosure as part of the divorce. In an agreed case, both spouses must complete the required preliminary disclosures so each person has information about income, expenses, property, and debts before finalizing the agreement.

Yes. Beginning January 1, 2026, California allows spouses to start a divorce or legal separation together by filing a joint petition.

You do not need to agree on every final term before filing the joint petition, but you must reach full agreement before the court can enter judgment through the joint process. If you cannot agree, either spouse may end the joint process and the case can continue as a regular divorce.

Filing a joint petition starts the case; it does not complete the divorce. You must still exchange financial disclosures, prepare a written agreement, submit the required judgment documents, and wait at least six months before the marriage can legally end.

Do we still have to exchange financial information if we agree on everything?

Yes. California requires financial disclosure as part of the divorce process. These disclosures provide information about income, expenses, property, and debts so both spouses can make decisions using current financial information.

The required preliminary disclosures still apply when you reach an agreement. In qualifying cases, spouses may agree to waive the final round of disclosures after completing the preliminary requirements.

How long does an uncontested divorce take in California?

California does not allow a divorce to become final immediately, even when you and your spouse agree on everything. A divorce takes at least six months.

In a regular divorce case, the six-month waiting period generally begins when the other spouse receives the divorce papers or appears in the case, whichever happens first. If you file a joint petition, the six-month period begins when you file it.

Your divorce may take longer if you need more time to reach an agreement, complete financial disclosures, prepare judgment documents, or correct paperwork requested by the court.
